About these Terms

Miglow is an iOS app published by Xinyang Li, a sole trader based in Victoria, Australia.

These Terms supplement the Apple Standard End User License Agreement, which governs your licence to use Miglow through the App Store. Where these Terms and mandatory rights under applicable law differ, the law applies.

Our Privacy Policy explains how information associated with Miglow is handled.

What Miglow is

Miglow is a diary for your own migraine history. It helps you record, organise and review the information you choose to enter, including recurring patterns in what you have recorded.

Not medical advice

Miglow does not diagnose, treat, prevent or predict any condition. Nothing it shows you is medical advice, and nothing should be used in place of advice from a doctor or pharmacist.

The patterns Miglow shows are drawn only from your own entries. They describe what you recorded. They do not establish cause, and they are not clinical findings.

If you are unwell, if your headaches change in character, or if you are worried about a symptom, speak to a health professional.

Not for emergencies

Miglow does not monitor your health and does not detect medical emergencies. It has no way to know how you are unless you tell it.

If you think you are having a medical emergency, call your local emergency number. In Australia, call 000.

Medication information

Medication information in Miglow is a record of what you entered. It is not a recommendation about which medication to take, how much to take, or when to take it.

Always follow the instructions of your doctor, pharmacist, or the medicine label.

Accuracy of your records

Miglow relies on the information you enter and does not verify it. You decide what to record, and you are responsible for checking that information before relying on it or sharing it with anyone else.

Reports and insights may be incomplete or inaccurate for the same reason. They are there to help you review and communicate your own history, not to replace clinical records or professional assessment.

Storage and backups

Miglow does not operate a server that receives or stores your entries. Your entries are stored locally on your device. If you have iCloud Backup enabled, Miglow's local app data may be included in backups managed by Apple under Apple's terms.

We cannot access your entries, and we cannot recover them for you.

Keeping a backup is your responsibility. You can export a copy of your recorded Miglow data from within the app at any time. If you delete the app, reset your device, or lose it without a usable backup, your records may be permanently lost and we may be unable to restore them.

Exports and sharing

If you export or share a report or your data from Miglow, you decide where it goes and who receives it. Once information leaves Miglow through a destination or recipient you choose, how it is handled is outside our control.

Check the recipient and the destination before sharing health information.

Notifications

Notifications and reminders are a convenience. They may be delayed, suppressed, or not delivered at all, because of device settings, operating system behaviour, or other factors outside our control.

Do not rely on Miglow notifications for medication timing, urgent health decisions, or emergency assistance.

Miglow Premium

Some features require Miglow Premium, a paid subscription billed through your Apple Account.

Subscriptions renew automatically until cancelled. Apple may charge your payment method shortly before the start of each new period. You can manage or cancel your subscription in your Apple Account subscription settings.

Purchases and refund requests made through the App Store are processed by Apple, subject to Apple's terms and any rights you have under applicable law.

Acceptable use

Do not use Miglow in any way that breaks the law. Do not attempt to reverse engineer, decompile, or extract the source of the app, except where the law gives you that right regardless of what this document says.

Age

You must be at least 18 years old to use Miglow.

Changes

We may update Miglow and these Terms from time to time. Where a change materially affects your rights or obligations, we will give reasonable notice in the app before it takes effect, where practicable. Where the law requires your express agreement to a change, we will ask for it.

Changes do not affect rights or obligations that arose before the change took effect.

Liability and your consumer rights

Miglow may not always be available, uninterrupted, or free from errors.

To the extent permitted by law, and subject to any rights and remedies that cannot be excluded, restricted or modified, we are not responsible for loss that was not reasonably foreseeable or that was caused by circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or any other applicable law. If you are a consumer in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Governing law

These Terms are governed by the laws of Victoria, Australia. The courts of Victoria have non-exclusive jurisdiction, subject to any right you may have under applicable consumer law to bring a claim elsewhere.
